1Provider and scope
Morning AI ("we") can be reached at support@morning-ai.app. These terms apply to the app and the website. How we handle personal data is described in the privacy policy.
If you obtained the app from Apple's App Store, Apple's Licensed Application End User License Agreement also applies. Where these terms say more, they add to it; Apple is not responsible for the app or its support.
2The service
Morning AI is a daily companion for iPhone: alarms, a spoken personal briefing, notes from meetings, an optional Day Record, an evening review and sleep sounds. Which features you can use depends on your plan, your iPhone and its iOS version, the permissions you grant and the sources you connect. The current scope is shown in the app.
We develop the app continuously and may add, change or remove features, as long as this is reasonable for you, taking into account our interests. If a change materially reduces a paid feature you are currently paying for, we will tell you in advance in the app.
3Account
You need an account (Sign in with Apple, Google or e-mail). You must be at least 16 years old. Provide accurate information, keep your sign-in secure, and tell us if you suspect misuse. An account is personal and may not be shared or transferred.
4Free plan, subscriptions and trials
The app can be used with a free plan that includes ads and limited features. Paid plans are auto-renewable subscriptions sold through Apple's In-App Purchase:
- Price: the price, currency and billing period are those shown in the App Store and on the purchase screen at the time of purchase. Prices can differ by country.
- Payment: Apple charges your Apple ID when you confirm the purchase. We never see your payment details.
- Renewal: a subscription renews automatically for the same period unless you turn off auto-renewal at least 24 hours before the current period ends. Your Apple ID is charged within the 24 hours before the period ends. Price changes follow Apple's rules, including any notice or consent Apple requires.
- Cancel: in iPhone Settings › [your name] › Subscriptions, or in the App Store under your account. Cancellation takes effect at the end of the paid period. Deleting the app or your Morning AI account does not cancel a subscription.
- Free trial: if the purchase screen offers a free trial, it is available only to eligible first-time subscribers and in the regions where Apple offers it. Unless you cancel at least 24 hours before the trial ends, it converts into a paid subscription. An unused part of a trial is forfeited when you buy a subscription.
- Refunds and statutory rights: refunds are handled by Apple (reportaproblem.apple.com) under Apple's terms. Your statutory consumer rights, including any right of withdrawal, remain unaffected and are exercised through Apple as the seller.
- Restore: Settings › Account › Restore purchases transfers an active subscription to a new device signed in with the same Apple ID.
5Recording other people — your responsibility
Meeting recording, Day Record, call notes and imported recordings capture what other people say. Whether you may record a conversation depends on the law where you are and on the people present, and you alone are responsible for complying with it. In particular:
- In Germany, recording the non-publicly spoken words of others without their consent is a criminal offence (§ 201 StGB).
- In Türkiye, recording conversations between other persons without their consent is a criminal offence (Art. 133 Turkish Penal Code, TCK).
- Many other countries and several US states (for example California) require the consent of all parties to a conversation.
- Employers, schools, courts, authorities and private venues may have their own rules.
Before you record, tell the people present and obtain their consent where the law requires it. Do not record conversations you are not part of. The app helps — consent screens, the microphone indicator and Live Activity, pause zones, "forget" functions, and during calls only your own side is written — but these do not replace your duty. You indemnify us against claims by third parties that result from recordings you made unlawfully, unless you are not at fault.
6AI-generated content
Briefings, summaries, action items, answers of the assistant, sleep insights and other texts are generated automatically by AI models from your data and from third-party sources such as news feeds and weather services. They can be wrong, incomplete or out of date. Check important information before you rely on it or act on it, especially before sending a draft or saving an event.
Nothing in the app is medical, legal, financial or other professional advice. Sleep and health features serve general wellbeing only; Morning AI is not a medical device and does not diagnose or treat anything. News summaries reflect the cited sources, not our opinion.
7Alarms
Alarms depend on your iPhone, its iOS version, volume, Focus and notification settings, battery and other circumstances outside our control. Do not rely on Morning AI alone where missing an alarm could cause harm, for example for medication or safety-critical appointments.
8Acceptable use
You may not:
- use the service for unlawful purposes, including recording people unlawfully or monitoring others secretly;
- upload or connect content you have no right to use, or that is unlawful, harmful or infringes others' rights;
- reverse-engineer, scrape, overload or disrupt the app, the servers or their security, or circumvent plan limits;
- create accounts automatically or for fraud, or resell the service;
- use the AI features to create content that is illegal, deceptive or harmful.
If you seriously or repeatedly breach these rules, we may restrict or suspend your account after warning you, or without warning where a warning cannot reasonably be expected.
9Your content
Your recordings, notes, transcripts and settings remain yours. You grant us the right to process them only as far as needed to provide the service to you, as described in the privacy policy. We do not use your content to train AI models and do not sell it. The texts the app generates for you are yours to use for personal purposes.
10Licence and intellectual property
We grant you a non-exclusive, non-transferable right to use the app for personal purposes for the duration of these terms. The app, its design, voices, sounds, texts and the Morning AI name are protected; you may not copy or distribute them beyond what the law allows.
11Connected services
If you connect Google, Microsoft, an IMAP mailbox, Notion, Apple Health or other services, their own terms apply in addition. We are not responsible for their availability or content. You can disconnect them at any time.
12Availability
We aim for high availability but cannot guarantee uninterrupted operation. Maintenance, faults of providers or of the internet, and events outside our control can interrupt the service. Many features need an internet connection.
13Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and where we have given a guarantee.
For slight negligence we are liable only if we breach an essential contractual obligation — one whose fulfilment makes the proper performance of the contract possible in the first place and on which you may regularly rely — and then limited to the damage that is typical and foreseeable for this kind of contract. Otherwise liability for slight negligence is excluded. These limits also apply to our representatives and agents.
14Ending the contract
You can stop using the app at any time and delete your account in Settings › Account › Delete account. A paid subscription is cancelled separately through Apple (see above). We can end the free use with reasonable notice, and any contract for good cause, for example a serious breach of these terms.
15Changes to these terms
We may update these terms, for example when features or the law change. We will tell you about material changes in the app before they take effect and, where the law requires it, ask for your consent. If you do not agree, you can end the contract as described above.
16Governing law and disputes
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of mandatory consumer law of the country where you habitually reside. If you are a merchant, a legal entity under public law or have no general place of jurisdiction in Germany, the place of jurisdiction is determined by the statutory provisions.
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
Should individual provisions be invalid, the rest of these terms remains valid.
